Terms of Service

These terms are an agreement between you and Opus55Vid ("Opus55Vid", "we", "us") for the use of opus55vid.com and its services (the "Service"). By creating an account or using the Service, you agree to these terms, our Privacy Policy and our Refund Policy. If you don't agree, please don't use the Service.

1. The Service

Opus55Vid turns a text description — a brand, a topic, a question or an idea — into a short animated video. An AI model writes the animation, and we render it into a video file you can download. You choose a style, a length and an aspect ratio, and you can ask for follow-up edits.

Opus55Vid is an independent product. It uses AI models made by Anthropic, but it is not affiliated with, sponsored or endorsed by Anthropic.

2. Your account

• You must be at least 18 years old, or the age of majority where you live, to use the Service.
• Give us accurate information and keep your login secure. You are responsible for everything done through your account.
• One person, one account. Creating multiple accounts to collect welcome credits is not allowed.
• If you use the Service for a business, you confirm that you are allowed to accept these terms for it.

3. Credits, subscriptions and payments

• Videos and edits are paid for with credits. The credit cost of each action is shown on our pricing section and before you start a job.
• New accounts receive 50 welcome credits once their email address is verified, once per email address. There is no free trial.
• Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time; your plan stays active until the end of the period you paid for.
• Payments are processed by Creem, our merchant of record, which handles billing, taxes and invoices. Your payment is also subject to Creem's terms.
• Credits have no cash value and can't be transferred or resold. Refunds of credits and payments are covered by our Refund Policy.
• We may change prices or credit costs. Changes don't affect a billing period you have already paid for, and we'll tell you in advance before a change applies to your subscription.

4. Acceptable use

Every prompt is checked by automated content moderation before it is processed. You agree not to use the Service to create or request content that:

• is illegal, or promotes illegal activity;
• sexualises minors in any way, or is sexually explicit;
• harasses, threatens, defames or promotes hatred or violence against people or groups;
• impersonates a real person or business, or is designed to mislead (for example fake endorsements, fake reviews or deceptive political content);
• infringes someone else's copyright, trademark, privacy or other rights;
• contains malware, or tries to attack, overload, reverse engineer or get around the limits of the Service.

We may block prompts, remove content, and suspend or close accounts that break these rules. Credits are not refunded for accounts closed for misuse.

5. Your content

"Your content" means the prompts, text and images you give us. You keep all rights to it. You give us a limited permission to use it only to provide the Service to you — for example to send it to the AI model, render your video and keep your project available — and to enforce these terms.

You are responsible for your content. If your prompt mentions a brand, logo, product, person or other material, you confirm that you have the right to use it in the way you ask.

6. Videos you create

As between you and us, you own the videos generated for you, and you may use them for personal and commercial purposes, subject to these terms and to any third-party rights in your content. We don't claim ownership of your videos and we don't use them in our own marketing without your permission.

Please keep in mind:

• Videos are made by AI. They can contain mistakes — wrong facts, numbers or spelling — so review every video before you publish it. You are responsible for how you use it.
• Similar prompts can produce similar videos for other users; we can't guarantee a video is unique.
• Rendered video files are kept for a limited time (see our Privacy Policy). Download anything you want to keep.

7. Our service

The Service, its software, styles, templates, sound effects and branding belong to us or our licensors. You may use the sound effects and visual elements only as part of the videos you create with the Service.

We work to keep the Service running well, but we may change, pause or discontinue features. If we shut down the Service, we'll give reasonable notice and refund unused credits from paid plans in proportion.

8. Ending your account

You can stop using the Service and ask us to delete your account at any time by emailing support@opus55vid.com. We may suspend or close your account if you break these terms, if required by law, or to protect the Service or other users.

9. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no warranties about it, including that it will be uninterrupted or error-free, or that videos will be fit for a particular purpose.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, such as lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

11. Indemnity

If someone makes a claim against us because of your content or your use of a video in breach of these terms or of their rights, you agree to cover our reasonable costs of dealing with it.

12. Governing law

These terms are governed by the laws of the place where the operator of the Service is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. Before starting any formal dispute, please contact us so we can try to solve it.

13. Changes to these terms

We may update these terms. If a change is significant, we'll tell you by email or on the site before it takes effect. If you keep using the Service after that, the new terms apply.
